Nationals of a treaty country can apply for a E2 visa to enter the United States by investing a substantial amount of capital in a U.S. business. There is no limit to the number of extensions of the visa, so the visa holders can enjoy unlimited stay in the U.S. with multiple entries.

Application Requirement

To apply for a U.S. E2 Visa, you need to satisfy following requirements: 

1. The applicant must be a national of a treaty country.

 

2. The applicant must have invested, or be actively in the process of investing, a substantial amount of capital in a bona fide enterprise in the U.S.

 

3. The applicant must have at least 50% ownership of the enterprise or demonstration of operational control over the enterprise, either by taking a managerial position or other corporate device.

 

4. The applicant should be able to provide a certificate of no criminal conviction.

5. The applicant should have no record of U.S. nonimmigrant visa rejection.

Program Benefits

1. E2 visa holders do not automatically become U.S. tax residents, only income generated in the U.S. are taxable for non U.S. tax residents.


2. There is no fixed investment requirement in order to apply for E2 visa, the total cost is relatively low compared to the EB-5 visa.
